DETERMINATION OF MINDED TO GRANT AN APPLICATION
FOR A LICENCE SUBJECT TO REQUIREMENTS NOTICE
UNDER SECTION 33A OF THE CONSUMER CREDIT ACT 1974
(‘THE ACT’)
An adjudicator, acting on behalf of the Office of Fair Trading (OFT), served a
notice on the Applicant that she was minded to grant the application for a
consumer credit licence subject to requirements. The case was transferred to
another Adjudicator for determination. The adjudicator received representations
from the Applicant.
Having considered the representations, the adjudicator decided to impose the
following requirements on the Applicant:
THE OFT REQUIRES AS FOLLOWS:
1.
Manor Financial Advice Ltd (‘MFA’) will ensure that all marketing,
advertising, and promotional or other oral or written representations
(including online and electronic materials, such as emails and websites)
(‘Marketing Materials’) which are used to bring the services of MFA to the
attention of consumers are clear, accurate and truthful and do not
mislead, either expressly or by implication or omission.
In particular MFA will ensure that it’s Marketing Materials;
(i)
do not falsely claim to, or imply that MFA offers debt
management solutions including Debt Management Plans
and Individual Voluntary Arrangements when it does not;
and
(ii)
clearly, accurately and truthfully set out the true nature of
the services MFA provides to consumers, including
providing clear information on what consumers’ personal
details will be used for and in particular what
circumstances this information will be passed to third
parties.
ANY FAILURE TO COMPLY WITH ANY OF THE ABOVE REQUIREMENTS
WILL RENDER YOU LIABLE TO FURTHER FORMAL ACTION BY THE
OFT, THIS COULD INCLUDE THE IMPOSITION OF A FINANCIAL

PENALTY OR THE REVOCATION OF YOUR CONSUMER CREDIT
LICENCE OR BOTH
Notice of any appeal, which must be given within 28 days of the date on which
notice of the determination is issued, and of its result, will be put on the public
register.
