ACTION
1. For the reasons given in this notice, the FSA hereby makes an order prohibiting Mr
Thommes from performing any controlled function involving the exercise of
significant influence in relation to any regulated activity carried on by any authorised
person, exempt person, or exempt professional firm (the “Prohibition Order”). This
order takes effect from 15 January 2013.
REASONS FOR ACTION
2. The FSA gave Mr Thommes a Decision Notice on 19 July 2011 which notified him
that the FSA had decided to impose the Prohibition Order pursuant to section 56 of
the Financial Services and Markets Act 2000 (the “Act”).
3. On 12 August 2011, Mr Thommes referred this Decision Notice to the Upper Tribunal
(Tax and Chancery Chamber) (the “Tribunal”). The written decision of the Tribunal
was released on 12 December 2012 and can be found on the Tribunal’s website.
4. The Tribunal determined, for the reasons given in its decision, that the FSA should
impose the Prohibition Order, pursuant to section 56 of the Act, prohibiting Mr
Thommes from performing any controlled function involving the exercise of
significant influence in relation to any regulated activity carried on by any authorised
person, exempt person, or exempt professional firm.
PROCEDURAL MATTERS
5. This Final Notice is given under, and in accordance with, section 390 of the Act.
6. Sections 391(4), 391(6) and 391(7) of the Act apply to the publication of information
about the matter to which this notice relates. Under those provisions, the FSA must
publish such information about the matter to which this notice relates as the FSA
considers appropriate. The information may be published in such manner as the FSA
considers appropriate. However, the FSA may not publish information if such
publication would, in the opinion of the FSA, be unfair to Mr Thommes or prejudicial
to the interests of consumers.
7. The FSA intends to publish such information about the matter to which this Final
Notice relates as it considers appropriate.
